1. Acceptance of Terms

By accessing or using Raisapp ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including business operators and their clients.

2. Description of Service

Raisapp is a SaaS platform designed for service businesses — primarily barbershops — to manage appointments, communicate with clients via SMS, and run day-to-day operations from a mobile-first interface. Features include appointment scheduling, client management, SMS confirmations, and usage-based billing.

3. User Accounts & Responsibilities

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• Each account is for a single business entity. Sharing accounts between unrelated businesses is prohibited.

4. SMS Communications & Consent

By using Raisapp's SMS features, you agree to the following:

• You, as the business operator, are responsible for obtaining proper consent from your clients before sending them SMS messages through Raisapp.
• SMS messages sent through Raisapp must be limited to appointment confirmations and service-related communications.
• You must not use the Service to send unsolicited commercial messages (spam).
• Recipients may opt out at any time by replying STOP. You agree to honor all opt-out requests immediately.
• Message and data rates may apply to end recipients based on their mobile carrier plan.

5. Payment & Billing

• Raisapp uses a usage-based pricing model. SMS messages are billed per message sent based on your active plan.
• Subscription fees (if applicable) are billed monthly in advance.
• All fees are non-refundable unless otherwise stated or required by law.
• We reserve the right to change pricing with 30 days' notice.
• Failure to pay may result in suspension or termination of your account.

6. Prohibited Uses

You agree not to use Raisapp to:

• Send spam, bulk unsolicited messages, or harassing communications.
• Violate any applicable law or regulation, including TCPA and CAN-SPAM.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to any part of the Service.
• Resell or sublicense the Service without written permission.
• Store or transmit malicious code or content.

7. Intellectual Property

All content, branding, and software comprising Raisapp are the intellectual property of Raisapp and protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

8. Limitation of Liability

To the maximum extent permitted by law, Raisapp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to Raisapp in the 3 months preceding the claim.

Raisapp does not guarantee uninterrupted or error-free service. We are not responsible for SMS delivery failures caused by third-party carriers or Twilio outages.

9. Termination

You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason with reasonable notice, except in cases of serious violations where immediate termination may occur.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the platform. Continued use of Raisapp after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
